Failure to Display Internal Labor Regulations: Enterprises Risk Unnecessary Fines

1. Obligation to Display Internal Labor Regulations

Internal Labor Regulations (ILR) are a set of general conduct rules established to regulate the behavior of employees and employers in labor relations. These regulations serve as the basis for reprimanding or disciplining employees.

Pursuant to Clause 4, Article 118 of the Labor Code 2019, internal labor regulations must be communicated to employees, and their key contents must be displayed in necessary locations at the workplace.

However, some enterprises currently fail to publicly display their internal labor regulations at the workplace. The act of failing to display internal labor regulations may result in administrative penalties.

2. Penalties for Failure to Display Internal Labor Regulations

According to Clause 1, Article 19 of Decree 12/2022/NĐ-CP, the following provisions apply:

Violations of Regulations on Labor Discipline and Material Liability

  1. A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed on an employer who fails to communicate internal labor regulations to all employees or fails to display the key contents of internal labor regulations in necessary locations at the workplace.

Thus, failing to display internal labor regulations in necessary locations at the workplace may result in an administrative fine ranging from VND 1,000,000 to VND 3,000,000.

Note: Pursuant to Article 6 of Decree 12/2022/NĐ-CP, the above fine applies to individuals. For organizations, the fine is doubled.
