Procedure for Obtaining the Certificate of Registration for Overseas Study Consultancy Services

Amid increasing global integration, the demand for overseas education among Vietnamese citizens has surged, fostering significant growth in the overseas study consultancy sector. To operate legally and professionally, enterprises must secure the Certificate of Registration for Overseas Study Consultancy Services as stipulated in Decree 125/2024/ND-CP, effective from November 20, 2024. This article offers a comprehensive guide on the scope of activities, conditions, required documents, and procedural steps to ensure legal compliance and build trust in the industry.

1. Scope of Overseas Study Consultancy Services

The business of overseas study consultancy services encompasses the following activities, as prescribed in Clause 2, Article 115 of Decree 125/2024/ND-CP:

  • Providing information and consultancy on the educational policies of various countries and territories; advising on the selection of schools, courses, majors, and academic levels suitable to the capabilities and aspirations of learners.
  • Organizing advertising, conferences, seminars, fairs, and exhibitions related to overseas education in accordance with legal regulations.
  • Conducting recruitment and enrollment for overseas study programs.
  • Organizing training programs to equip Vietnamese citizens with necessary skills for studying abroad.
  • Facilitating the travel of Vietnamese citizens for overseas study and arranging visits for parents or legal guardians to training institutions abroad, in compliance with legal regulations.
  • Other activities related to the business of overseas study consultancy services as permitted by law.

2. Conditions for Obtaining the Certificate

Pursuant to Article 116 of Decree 125/2024/ND-CP, enterprises must meet the following conditions to be granted the Certificate of Registration for Overseas Study Consultancy Services:

  • Facilities: Maintain a stable operational premises equipped with adequate facilities and equipment to support overseas study consultancy activities. The enterprise must possess consultancy materials on the educational policies of various countries, as well as information on schools, courses, majors, and academic levels.
  • Personnel: Staff directly engaged in consultancy must meet the following requirements:
    a) Hold a university degree or higher and possess foreign language proficiency at a minimum of Level 4 according to the 6-level Foreign Language Proficiency Framework for Vietnam (or equivalent).
    b) Possess a certificate of training in overseas study consultancy as prescribed.

3. Documents Required for Application of the Certificate

The enterprise must prepare a complete set of documents, including:

  • Application for the Certificate: Clearly stating the objectives, content of activities, capacity to develop overseas study consultancy services, implementation plan, and measures to address risks for clients (as per Form No. 07, Annex IV, Decree 125/2024/ND-CP).
  • Copy of the Enterprise Registration Certificate: The copy must be certified or accompanied by the original for verification.
  • Legal document proving land use rights, ownership of premises, or a lease agreement for the location of the overseas study consultancy service organization.
  • List of consultancy staff: Including personal information (full name, date of birth, gender), professional qualifications, foreign language proficiency, job position, along with certified copies of university degrees, foreign language certificates, and certificates of training in overseas study consultancy.

4. Procedure and Process for Issuance of the Certificate

The process for obtaining the Certificate includes the following steps:

Step 1: Preparation and Submission of Documents

  • The enterprise prepares one set of documents as prescribed.
  • The documents are submitted via the online public service portal, by post, or directly at the Department of Education and Training in the locality where the enterprise conducts its overseas study consultancy activities.

Step 2: Document Review and Appraisal

  • Within 15 days from the receipt of a complete and valid set of documents, the Department of Education and Training will conduct an appraisal and prepare a report to evaluate compliance with the conditions stipulated in Article 116 of Decree 125/2024/ND-CP.

Step 3: Issuance of the Certificate

  • Within 05 working days from the date of the appraisal report, if the documents meet the requirements, the Director of the Department of Education and Training will issue the Certificate of Registration for Overseas Study Consultancy Services (as per Form No. 09, Annex IV, Decree 125/2024/ND-CP). If the documents do not meet the requirements, the enterprise will receive a written notification stating the reasons.

Note: The Certificate will be publicly announced through mass media, ensuring transparency and facilitating the enterprise’s operations.
